A New Hampshire court's decision to order a 10-year-old home-schooled girl to attend public school is coming under attack from some social conservatives and religious freedom advocates.

The Alliance Defense Fund, an Arizona-based organization that seeks to preserve religious liberty and the sanctity of marriage, has asked a family court judge to reconsider her July 14 decision to send the girl, identified in court documents as "Amanda," to a public school in Meredith, N.H.

A 10-year-old homeschool girl has been told by a New Hampshire court official to attend a government school because she was too "vigorous" in defense of her Christian faith.

According to court documents, the guardian ad litem earlier had told the mother, "If I want her in public school, she'll be in public school." The guardian ad litem had an anti-Christian bias, the documents said, telling the mother at one point she wouldn't even look at homeschool curriculum. "I don't want to hear it. It's all Christian based," she said.

The religious freedom upon which our democracy was founded is in serious jeopardy. The closure of Calvary Christian School in Derry, N.H., as reported in Wednesday's Eagle-Tribune, is just one indication of this dire situation.

Throughout the country, the existence of religiously-affiliated educational institutions is threatened by the inability of taxpaying citizens to pay tuition. If education is mandatory in a state, a minimum amount of funding should be provided to all school-age children so that their parents, not the government, can decide where their children are taught.

When Sharon and Bob Johnson decided to adopt one more child, they never dreamed they'd end up with Kylie, a 9-month-old who came to them through the state's foster care program.

In August 2007, Sharon decided to pursue foster parenting instead, and she and her husband took the required classes. Five months after they became licensed foster parents, Sharon said she received a telephone call from the state's Division for Children, Youth and Families' Rockingham County office.

The child would remain in the hospital without Owen present. The baby would be placed into the protective custody of the Massachusetts Department of Social Services. Birk said authorities got an idea about Owen, and refused to let go. "They weren't interested in finding the truth," he said.

No law can override the US Constitution. In New Hampshire, it's laws are also secondary to the NH Constitution. Each document has a Bill of Rights designed to place clear limits on the power of the government.

The right to be let alone is indeed the beginning of all freedom. However, this doesn't prevent the state's legislature from passing laws that are unconstitutional.
