Court Order Disregarded

I am the mother of 4 boys, who were ordered by a Texas court ruling to live with me. At the time of pick up, in Kentucky, I was served with an emergency temporary restraining order, (the emergency being I was going to get the boys).

I have spent almost a year going from court to court in Kentucky to have the valid Texas ruling honored and I am being road blocked at all levels so far and have been prevented from seeing my children.

This is true injustice in the justice system and the UCCJEA rules are even being ignored by Kentucky. Who can help when judges do not uphold the law? Please respond.

The Judicial Conduct Commission is the only entity authorized under the Kentucky Constitution to take disciplinary action against a sitting Kentucky judge. The Commission investigates and reviews complaints against judges and, when warranted, conducts hearings regarding the alleged misconduct where evidence is presented.

You might also contact the Texas court and ask them to issue a contempt of court citation.

I have a custody of my niece the custody was awarded in VA. Both parents turned custody over to me and I have full custody (signed by a judge). Recently my brother went to court in PA (where the Bio-parents live)concerning child support on a older sibling. While there a DSS worker entered the court room and informed the parents that DSS was going to get a court order and take my niece from me and place her in foster care until they (DSS) could prove paternity. (my brother was in jail at the time of birth and never signed the birth ceretificate) Anyhow my brother signed paternity at the hearing. Now What I was confused about was, why DSS was involved when my niece's name was not on the court order. As it turned out DSS did not even know where the child was and assumed she was with the bio-mother. DSS had no such court order to remove the child from anyone, they lied. I spoke with three lawyers one in PA, that said that DSS could not go agaist a custody order in another state. My lawyer said that DSS in PA would have to go through the courts in VA to get a court order in VA to change to custody order. (she said not likely to happen) Family law lawyer said basicly the same. So if you have a custody order in TX it should stand up in KY. I would also report them to TX for comptempt of court.
