MO: Discipline Laws

I just visited your website and I appreciate the info. that you provide. I am wanting to learn more about the Missouri laws on discipline (spanking). And my rights if DFS ever falsely accuses me of abuse. If you could help me learn more about this, I would greatly appreciate it.

Thank you,
Stephanie

Dear Stephanie,

The information you are looking for is located here:

Missouri Spanking Laws

It says:

Discipline including spanking, administered in a reasonable manner, is not abuse.
Sec. 210.110. [Civil Code]

Force justified if by parent/guardian/other person with care and supervision of minor if- -- Person believes force necessary to promote welfare of minor, and -- Force used is not designed to cause or believed to create a substantial risk of causing death, serious physical injury, disfigurement, extreme pain, or extreme emotional distress.
Sec. 563.061. [Criminal Code]

Who decides what is extreme pain, or extreme emotional distress?

Spank at your own risk.

I thought that spanking was intended to cause extreme emotional distress. Or is it standard emotional distress? Who determines the difference?

Spanking is a human being's display of dominance, with the intent of having the child become submissive.

The law is intentionally created to allow the police officer, or prosecutor to do as they wish. Fortunately, I haven't seen an abuse of discretion on the part of either.
